Using this site

apexcapitalrealty.com (the "Site") is operated by APEX Capital Realty, LLC ("APEX", "we", "us"), a licensed Florida real estate brokerage. By using the Site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Listing information

Property information on the Site — including prices, sizes, availability, photographs and descriptions — is provided by property owners, public records and other sources we believe reliable, but we do not guarantee it. All listings are subject to errors, omissions, change of price or terms, prior sale or lease, or withdrawal without notice. Square footage and lot sizes are approximate. Verify anything material to your decision independently, and ask the listing advisor for the offering memorandum before relying on any figure.

Properties marked Sold or Leased are shown as they were published while they were on the market and are no longer available. Sale prices on closed transactions are from public record or press coverage unless otherwise stated.

No brokerage relationship by using the site

Browsing the Site or sending us an inquiry does not create an agency, brokerage or advisory relationship, and nothing on the Site is legal, tax, investment or insurance advice. A brokerage relationship with APEX is formed only by a written agreement. Florida law requires us to disclose our brokerage relationship to you before or at the time we begin working with you; your advisor will provide that disclosure.

Forms and communications

When you submit a form you agree that the information is accurate and that we may contact you about your request by the means you provided. Consent to receive text messages is separate and optional; see the next section. Submitting a form does not by itself opt you in to text messages.

Text messaging (SMS) terms

APEX offers two text-message programs, each opted into separately on our contact form:

• Informational messages — updates or responses related to your inquiry and property details.
• Transactional messages — messages related to a transaction you are part of, such as scheduling, documents or closing updates.

By opting in you consent to receive these messages from APEX Capital Realty at the mobile number you provided. Messages may be sent using automated technology. Consent is not a condition of purchase or of any service. Message frequency varies. Message and data rates may apply. If you separately opt in to marketing communications, you consent to receive marketing and promotional text messages, calls and emails from APEX about offers and services.

Opting out. Reply STOP to any message to cancel. You will receive one confirmation message and then no further messages from that program unless you opt in again. Reply HELP for help, email [email protected] or call (305) 570-2600.

Carriers. Messages are supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages, and neither APEX nor its service providers are responsible for delays or failures caused by carriers or networks. We do not share or sell your mobile number or your consent information; see the Privacy Policy.

APEX TrueValue™ Report and APX Insure

The TrueValue™ Report is an opinion of value prepared by APEX for the purposes described on its page; it is not an appraisal under Florida law and should not be relied on as one. Orders are placed through a separate order form whose terms apply. APX Insure (Apex Capital Realty Insurance LLC) is a separately licensed insurance agency; insurance quotes and coverage are subject to the terms of the policies issued by the carriers.

Intellectual property

The Site's text, photographs, design, logos and marks, including APEX Capital Realty, APEX TrueValue™ and APX Insure, belong to APEX or are used with permission. You may view and print pages for your own reference. You may not copy, republish, scrape or use the Site's content for any commercial purpose without our written permission. Listing photographs may not be reused.

Acceptable use

You agree not to use the Site's forms to send spam or unlawful content, not to interfere with the Site's operation, and not to attempt to access any part of the Site or its systems that is not intended for the public.

Third-party sites

The Site links to third-party websites and services, including listing portals, maps and an order form. We are not responsible for their content or practices; their own terms apply.

Disclaimer and limitation of liability

The Site is provided "as is". To the fullest extent permitted by law, APEX disclaims all warranties, express or implied, about the Site and its content, and is not liable for any indirect, incidental or consequential loss arising from your use of the Site or reliance on its content. Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of Florida. Any dispute relating to the Site will be brought in the state or federal courts located in Miami-Dade County, Florida.

Changes

We may update these terms from time to time by posting the revised version here with a new date. Continued use of the Site after a change means you accept the revised terms.
