How APEX Capital Realty collects, uses and protects the information you give us on this website and through our text-messaging program.

Who we are

APEX Capital Realty, LLC ("APEX", "we", "us") is a licensed Florida commercial real estate brokerage with offices at 561 NE 79th Street, Suite 420, Miami, FL 33138 and 1110 Sligh Blvd, Orlando, FL 32806. This policy applies to apexcapitalrealty.com (the "Site") and to the text messages we send to people who opt in.

Information we collect

Information you give us

When you fill in a form on the Site — a property inquiry, a contact request, an insurance quote request, a TrueValue™ Report request or an inquiry about joining APEX — we collect what you enter: typically your name, email address, phone number, the property address and asset type you are asking about, and anything you write in the message field. If you tick a text-messaging consent box, we also record that consent, the wording you agreed to and the time you submitted the form. If you subscribe to the APEX newsletter, we collect your email address so we can send it to you.

Information collected automatically

Like most websites, the Site records standard technical information when you visit: the pages you view, the page that referred you, your browser and device type, and an approximate location derived from your IP address. We may use cookies or similar technologies for analytics so we can see which pages are useful and keep the Site working properly. The Site also uses the Meta (Facebook) pixel, which may let us show you our advertising on Meta's platforms after you have visited, and the Follow Up Boss website pixel, which recognizes a visitor who arrives from one of our emails so the advisor you already know can follow up. Our forms use Cloudflare Turnstile to tell people from automated spam; it checks signals from your browser and does not ask you to solve puzzles unless it is unsure. You can block cookies in your browser settings; the Site's pages will still work.

How we use your information

To respond to your request and route it to the right person at APEX — the advisor on the property you asked about, our insurance team, or the person who handles general inquiries.
To send you the text messages you have opted in to receive (see below).
To send you the APEX newsletter if you subscribed to it. Every issue has an unsubscribe link.
To keep records of transactions and inquiries as a licensed brokerage is required to do.
To understand how the Site is used and to improve it.
To protect the Site and our business from fraud, spam and misuse.

We do not sell your personal information.

Text messaging (SMS) program

APEX offers text messaging to people who ask for it. On our contact form you may choose to opt in to informational messages (updates or responses related to your inquiry and property details) and, separately, to transactional messages related to a transaction you are part of. Both boxes are unchecked by default, neither is required to submit a form, and consent is not a condition of purchase or of any service.

Message frequency varies with your inquiry or transaction.
Message and data rates may apply according to your carrier plan.
You can opt out at any time by replying STOP to any message. Reply HELP for help, or contact us using the details below.
Messages may be sent using automated technology.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We will not sell your mobile telephone number or your consent data to any third party, and we will not share that information with any third party for cross-context behavioral advertising or targeted advertising purposes.

How we share information

We share personal information only in these circumstances:

Inside APEX. Your inquiry goes to the APEX advisor or team member best placed to answer it. Everyone who receives it uses an APEX email account.
Service providers. Companies that host the Site and deliver our email and text messages process information on our behalf and under our instructions. They may not use it for their own purposes.
Legal reasons. When we believe disclosure is required by law, regulation or legal process, or is necessary to protect the rights, property or safety of APEX, our clients or others.
Business transfers. If APEX is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction, subject to this policy.

We may share aggregated or de-identified information that cannot reasonably be used to identify you.

How long we keep information

We keep inquiry and consent records for as long as we need them to respond to you, to comply with Florida real estate record-keeping requirements and other legal obligations, to resolve disputes and to enforce our agreements. If you opt out of text messages we keep a record of that opt-out so we honor it.

Your choices

Text messages: reply STOP to any message to stop receiving them.
Newsletter: use the unsubscribe link in any issue, or email us, and we will take you off the list.
Email: tell us at [email protected] and we will stop contacting you about your inquiry, other than to confirm your request.
Access, correction and deletion: email us and we will tell you what we hold about you, correct it, or delete it where we are not required to keep it.
Cookies: control or block them in your browser settings.

Security

We use reasonable physical, technical and administrative measures, matched to the sensitivity of the information, to protect it against accidental loss and unauthorized access, use or disclosure. No website or email system can be guaranteed to be completely secure, so please do not send us sensitive financial or identity documents through the Site forms; your advisor will tell you how to deliver them safely.

Children

The Site is for businesses and adults. We do not knowingly collect information from anyone under 18.

Links to other sites

The Site links to third-party sites such as LoopNet, Crexi, Google Maps and the Jotform order form for the TrueValue™ Report. Their privacy practices are their own; please read their policies.

Changes to this policy

We will post any changes on this page and update the date at the top. Material changes to the text-messaging program will be communicated to opted-in subscribers.
